1. Acceptance of Terms

By accessing or using RAMFlowAI's website (ramflowai.org), desktop application, or cloud service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

RAMFlowAI is an open-source, AI-powered memory optimization tool for Windows. The Service includes:

RAMFlowAI Desktop Application: A free, open-source application that monitors and optimizes system memory using AI analysis.
RAMFlowAI Cloud: An optional paid subscription service ($1/month) that provides access to our optimized AI infrastructure for unlimited memory cleanup operations.
Self-Hosted Mode: The ability to use the application with your own AI API provider at no charge from RAMFlowAI.

3. Account Registration

To use RAMFlowAI Cloud, you must create an account. You agree to:

Provide accurate and complete information during registration
Maintain the security of your account credentials and API key
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

4. Subscription and Payment

4.1 Pricing

RAMFlowAI Cloud is offered at $1 per month. This provides unlimited AI-powered memory cleanup operations.

4.2 Billing

Subscriptions are billed monthly. Payment is processed through our third-party payment provider. You authorize us to charge your selected payment method on a recurring basis.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to RAMFlowAI Cloud until the end of your current billing period. No refunds are provided for partial months.

4.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated at least 30 days in advance and will apply to the next billing cycle.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, exploit, or abuse the RAMFlowAI Cloud API
Share your API key with unauthorized third parties
Use the Service to interfere with or disrupt other systems or networks
Resell or redistribute access to RAMFlowAI Cloud without authorization
Use automated means to create multiple accounts to circumvent usage policies

6. Open Source License

The RAMFlowAI desktop application is released under the MIT License. You are free to use, modify, and distribute the application in accordance with that license. The open-source license applies to the application code only and does not grant rights to the RAMFlowAI Cloud infrastructure, AI models, or cached optimization data.

7. Intellectual Property

The RAMFlowAI name, logo, website content, AI models, cached cleanup patterns, and cloud infrastructure are the intellectual property of RAMFlowAI. The open-source application code is licensed separately under the MIT License.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

RAMFlowAI does not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
The AI recommendations will be accurate or appropriate for every system configuration
Memory optimization results will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAMFLOWAI AND ITS TEAM MEMBERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, SYSTEM DOWNTIME, OR DAMAGE TO COMPUTER SYSTEMS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

RAMFlowAI's total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Process Termination Acknowledgment

You acknowledge that RAMFlowAI may trim memory from or close running processes on your computer based on AI analysis. While the application includes safety mechanisms and protected process lists, you accept the risk that the Service may affect running applications. You are responsible for saving your work regularly and configuring the application's settings appropriately for your needs.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use RAMFlowAI Cloud ceases immediately. The open-source application may continue to be used in self-hosted mode.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
